The first BFME, released in 2004, was made based solely on the Peter Jackson's movies, while BFME 2 was a by-product of EA's acquisition of also the gaming rights for the books from 2005 until 2010 (allowing them to expand on the LOTR universe the way they did). Unfortunately, no just like they could not continue running the servers for the BFME games, EA are not able to sell it in any way without reacquiring the rights for LOTR for both the films and the books. I'll paste here the explanation from the last time someone asked if they could buy a digital version of one of the Battle for Middle Earth games: In other words, you can only get it legally by finding those last copies that got lost on bargain bins or in some warehouse. You can only buy physical copies of the game and they are no longer in production.
